This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you interact with our business.
It applies to our physical nursery, telephone, text message and email communications, our website at https://www.fruittreesonly.com, customer services, purchases, delivery and installation requests, special plant requests, newsletters, plant-care support, and our automated assistance features.
It also describes how we work with service providers, including Square, our email and messaging providers, and our website infrastructure providers.
By using our services, you acknowledge that this Privacy Policy is available to explain our information practices. Where consent is legally required, we will seek that consent separately.
2. Information We Collect
Depending on your interactions with Fruit Trees Only, we may collect:
Contact information: Name, email address, telephone number, mailing address, delivery address, and other contact details.
Purchase information: Products purchased, order details, payment status, receipts, transaction references, purchase history, and customer-service records.
Service information: Delivery and installation requests, estimates, requested plant varieties, quantities, preferences, special plant requests, scheduling information, and related correspondence.
Plant-care information: Descriptions of plant problems, growing conditions, customer-submitted photographs, diagnostic questions, and support history.
Assistant interaction information: Questions, messages, feedback, and other information voluntarily submitted through Ask a Plant, Maxi, or similar automated assistance features.
Newsletter information: Email address, name if supplied, subscription preferences, and subscription and unsubscribe records.
Website and technical information: IP address, browser type, device characteristics, cookies, website activity, security logs, and approximate location inferred from technical information.
We request that customers avoid submitting unnecessary sensitive information, such as Social Security numbers, financial account credentials, medical records, or identification documents through our website forms or automated assistance features.
3. How We Collect Information
We collect information directly from customers during purchases, service requests, newsletter subscriptions, support interactions, telephone calls, text messages, emails, and website submissions.
We may also receive information through authorized business systems, including Square and other providers supporting our operations.
Certain technical information is collected automatically when customers visit our website through hosting, security, and analytics technologies.
We may associate information from separate interactions when reasonably necessary to fulfill customer requests, verify identity, maintain accurate business records, or provide consistent service.
4. How We Use Information
We use personal information to:
- Process purchases, payments, orders, and refunds.
- Provide product information, availability, and pricing.
- Prepare and manage delivery and installation estimates.
- Respond to special plant requests and coordinate fulfillment.
- Provide plant-care guidance, diagnosis, and customer support.
- Operate Ask a Plant, Maxi, and other customer assistance services.
- Verify customer identity before providing protected information.
- Communicate about transactions, service requests, and appointments.
- Send newsletters and promotional communications to subscribers.
- Understand website usage and improve our services.
- Maintain and protect our services, prevent fraud, and maintain system security.
- Comply with legal obligations and maintain necessary business records.
Providing contact information for an estimate, special plant request, or customer support inquiry does not automatically subscribe a customer to marketing communications.
5. Automated Assistance Features
Fruit Trees Only provides automated assistance features, including Ask a Plant and Maxi, to help customers with plant-care questions, product discovery, and service requests.
Information you submit through these features is handled as described in this Privacy Policy. It may be reviewed by our employees, and we use it to respond to you, provide support, and maintain and protect our services.
Automated responses are informational and may be incomplete or inaccurate. They do not replace confirmation of price or availability by our staff, or the directions on a product label. You may ask to speak with a Fruit Trees Only employee at any time.
If we adopt new technologies for these features that use customer information in a materially different way, we will update this Privacy Policy first and, where required by law, obtain your consent.
6. Plant Diagnosis, Photographs, and Customer Support
Customers may submit photographs, descriptions, and other information to request plant-care assistance.
We use this information to evaluate potential plant problems, recommend possible solutions, document support cases, and provide additional assistance when necessary.
Diagnostic photographs and associated records may be accessible to authorized employees responsible for customer support.
We ask customers to avoid including unrelated personal information, identifiable individuals, documents, or other private details in submitted photographs.
Closed plant-diagnosis case photographs are generally retained for up to 24 months after case closure, and then become eligible for deletion in our periodic records review. We may keep them longer where necessary for applicable legal obligations, disputes, or authorized preservation requirements.
7. Estimates, Delivery, Installation, and Special Plant Requests
When customers request delivery, installation, an estimate, or a special plant order, we may collect contact details, delivery locations, plant preferences, requested quantities, service information, and related communications.
Delivery addresses may be processed through mapping or distance-calculation services to determine service eligibility, estimated distance, and delivery charges.
We may use submitted information to contact customers, prepare estimates, coordinate employee follow-up, arrange services, and fulfill special plant requests.
Where necessary, limited information may be shared with appropriate suppliers or service providers to fulfill a customer request.
Retention: Closed estimate requests and special plant requests are generally retained for up to 24 months after the request is closed, and then become eligible for deletion in our periodic records review. They may be kept longer where necessary for applicable legal obligations, preservation requirements, and records that must be maintained separately for accounting or transaction purposes.
Submitting a request does not automatically enroll a customer in marketing communications.
8. Newsletter and Email Communications
Fruit Trees Only offers an optional email newsletter featuring plant-care information, seasonal updates, product announcements, and promotional offers.
Newsletters may be delivered through a third-party email service provider acting on our behalf. When customers subscribe, we may provide that provider with their email address, name if supplied, subscription preferences, and information necessary to manage the subscription and deliver messages.
Newsletter enrollment is voluntary and separate from purchases, estimates, special plant requests, and customer support. We use a two-step confirmation: you are subscribed only after you confirm the request from the email we send you.
Subscribers may unsubscribe at any time using the unsubscribe link included in promotional emails or by contacting Fruit Trees Only.
We may continue sending nonpromotional communications necessary to process purchases, respond to customer requests, or provide requested services after a customer unsubscribes from marketing.
9. Telephone, Email, and Mobile Messaging Communications
Fruit Trees Only may contact customers by telephone, email, or text message regarding purchases, orders, estimates, special plant requests, deliveries, installations, appointments, plant-care assistance, and other customer-initiated services.
Transactional and Customer Service Communications
When customers provide their contact information, we may use that information to respond to inquiries and communicate about their requested products or services, subject to applicable consent requirements.
These communications may include order confirmations, appointment reminders, delivery updates, estimate follow-ups, special plant availability, and customer support responses.
SMS and Mobile Messaging Consent
Customers who opt in to receive text messages from Fruit Trees Only may receive messages related to the specific messaging program for which they provided consent.
Message frequency varies depending on customer interactions and requested services. Message and data rates may apply.
Customers may opt out of text messages at any time by replying STOP to a message. Customers may reply HELP for assistance or contact Fruit Trees Only at (904) 621-0823 or [email protected].
Consent to receive promotional text messages is not a condition of purchasing products or receiving services.
Where required, we obtain separate consent for promotional messages and transactional or informational messages.
Mobile Information Sharing and Protection
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
All other categories of information sharing described in this Privacy Policy exclude text messaging originator opt-in data and consent. This information will not be shared with third parties or affiliates for their own marketing or promotional purposes.
We do not sell, rent, or transfer SMS consent records to third-party marketers or lead generators.
We may use authorized messaging service providers, including Square and our telephone service provider, solely to deliver communications on our behalf, maintain messaging operations, and process customer opt-out requests, subject to appropriate safeguards.
Email Communications
Customers may receive emails regarding their transactions, estimates, special plant requests, and customer service inquiries.
Promotional newsletters are managed separately from transactional email. Customers may unsubscribe from promotional emails at any time without affecting necessary communications regarding active purchases or requested services.
Communication Preferences
Customers may contact Fruit Trees Only to update their communication preferences or request assistance with unsubscribing from promotional communications.
We honor applicable communication opt-out requirements and maintain appropriate records of customer preferences.
